7) Intellectual property:

The Platform (its design, graphics, organization and content) is an original work and constitutes the exclusive property of the Company. Any total or partial reproduction of the Platform, carried out without the consent of the author or their successors or assigns, is unlawful. The same applies to any translation, adaptation or arrangement, by any means whatsoever.

8) Modification of the Platform

The Company reserves the right to modify or correct the content of the Platform and these Legal Notices at any time and without prior notice.

9) Application of the General Terms of Use and Sale

The General Terms of Use (available in the “G.T.U.” section of the Platform) apply mandatorily to any person connecting to the Platform.

Likewise, the Company’s General Terms and Conditions of Sale (available in the “G.T.C.S.” section of the Platform) apply in the event any person connecting to the Platform orders paid Services offered by the Company.

10) Dispute resolution – Mediation

In the event of any question, difficulty or dispute relating to the Platform or Services offered by the Company, any person connecting to the Platform is invited to first contact Customer Service (details provided above) in order to seek an amicable solution.

In the event of a dispute with a consumer, the Company and the consumer shall in any case endeavor to find an amicable solution prior to any court proceedings.

Failing amicable agreement, and subject to any mandatory rules more favorable to the consumer, the competent courts of Dublin (Ireland) shall have non-exclusive jurisdiction over any dispute relating to the Platform and/or the Company’s Services.

Any person connecting to the Platform may also seek information on out-of-court consumer dispute resolution mechanisms available to them, in particular:

  • in Ireland, through the Competition and Consumer Protection Commission (CCPC), which provides information on alternative dispute resolution (ADR) mechanisms and applicable procedures. Consumers may also, where conditions are met, use the “Small Claims” procedure (District Court) for certain low-value disputes;

  • in the event of cross-border disputes within the EU/EEA, through the European Consumer Centre Ireland (ECC Ireland), which provides free information and assistance to consumers.

Mediation for consumers residing in France (AME CONSO)

“When a consumer residing in France fails to reach an amicable solution following a written complaint sent to the Company, they may refer the matter free of charge to the Company’s designated consumer mediator, AME CONSO, within one year from that written complaint.”

Any person remains free, where applicable, to use any other mediation body or alternative dispute resolution entity competent in their country of residence, under conditions specific to that entity.
